The Board does NOT vote on the dismissal charges. In most cases, the teacher will request a hearing before an ISBE hearing officer (105 ILCS 5/34-85). Only after a hearing and the issuance of a recommended decision of an ISBE hearing officer will the Board formally vote to discharge a tenured teacher. Let me know if you have any other questions. In the instances when the Chicago Board of Education votes to fire a tenured teacher, for cause, the most common choices for the teacher to select are: to resign, enter into a negotiated employment settlement agreement or appeal the case to a tenure hearing officer. But in theory, a tenured teacher can deliberately choose to be fired by doing none of the above. Can you recall an instance of this happening in your school district during the past five years? Please email me back whether or not your school district has had such a case by Wednesday March 12. If your school district has had such a case, please include the year it happened, the name of the teacher involved (it would have been voted on in an open meeting).
